                         This Privacy Policy is applicable to and its sub domains and related websites (“Website”) owned by CYBERNATICS (“Company”) offering online technical support services to its Users (“Services”). The Company acknowledges and respects its Users’ personal privacy. This Privacy Policy (“Policy”) describes all aspects related to the collection of information while a User visits the Website and forms a part of the Agreement between a User and the Company. The terms defined in the Terms of Use shall have the same meaning and connotation in this Privacy Policy.


                             We recommend User to read before using the Website or submitting any personal information. By Accessing the Website, User accepts and consents to the practices described in this Policy. By a User’s continued use, he/she expressly consents to collection, storage, use and disclosure of his/her personal information by the Company as described in this Policy. If a User does not agree on the terms of privacy policy, he/she is free to discontinue his/her use or accessing the Website at any time. The Company reserves the right to modify or add any clauses to this Policy at any time without prior notice. The Company advises Users to read the Policy each time they access the Website.

1. Information we collect:

a. Company will record a User’s visit when he/she accesses the Website but will not collect any Personal Identifiable Information (i.e., information that is about a User and identifies him/her) unless otherwise stated. User is not entitled to use the Services and request for any Services on the Website if the user is under the age of 18 years.


b. Before purchasing any Products or Services on the Website , User is requested to fill the order form that includes details such as full name, e-mail address, residential address, city, state, country, year of birth, phone number, and a valid mobile phone number and/or gender.


c. Company will require User’s account or credit card data in order to process payment against an order placed by a User. It is clarified that no credit card data is stored by the Company on its server as its payment processing is handled by SSL-secured net-banking third- party payment gateway of banks. Except when required to fill in confidential information in SSL secured net banking or credit card transaction page, user agrees and warrants that he/she has neither revealed nor will reveal any confidential information pertaining to his/her credit card details , including credit card number and password, and the password of his/her e-mail address to any telesales at any stage, before or after booking an order or availing any Services, or writing feedback or acting at any stage with reference to Products or Services mentioned on the Website.


2. Use of Information:

a. The personal information submitted by a User at the time of placing the order shall be utilized by the Website to render the requested technical support services/products, for sending information about new technical service plans, status of delivery of services, confirmation of completed service, contact user for clarifications, notifications, and some promotional information. In case User does not wish to receive marketing or other promotional materials, he/she may unsubscribe this service using the unsubscribe link on the Website or using the information in the Company’s e-mail that contains the procedure to unsubscribe.


b. The Company will also use and analyses the information it collects from the User so that it can administer, support, improve and develop its Services. In particular, Company may use a User’s Personal Identifiable Information to contact a User (by e-mail, telephone or mobile number) for his/her views on the Company’s Services and to notify him/her occasionally about his/her feedback on the Website or Services. The Company may use User’s Personal Identifiable Information to occasionally notify him/her about special offers on products and Services that he/she may find useful, or offers from companies with whom the Company has business relationships.


c. The Company may also use a User’s Personal Identifiable Information to ensure that content from Website is presented in the most effective manner for him/her and his/her computer. User’s Personal Identifiable Information shall not be used by the Company for any promotional purposes in printed material and other media without a User’s express permission, although it may be used for internal assessment by the Company to analyses the orders placed a User and successful completion of orders amongst other details that may be compiled by the Company, for evaluating and improving service experience of Users on the Website or other legitimate purposes unless expressly stated otherwise in the Agreement.


d. The Company reserves the right to verify the identity of each User if it suspects any illegal activity or any other activity in breach of the Company’s Terms of Use from a User‘s end and to take necessary measures.


3. Disclosure of Personal Identifiable Information:

a. Personal Identifiable Information of a User may be disclosed (if required) only to those parties that assist the Website by providing technical, logistical or other services. If User’s Personal Identifiable Information is incomplete or incorrect, the Company may be unable to process transactions or provide Services to him/her for which the User is completely responsible. Kindly read the Charge back and Refund policy also before placing an order for services on the Website.

No claim of charge-back shall be admissible in-case of satisfactory delivery of Services during the contract period. Also, no request for change in ordered Services or in the duration of the plan opted can be entertained nor any charge-back claimed at any point of time.


In case a User alleges deficient or dis-satisfactory delivery of Services, the User must substantiate with supporting documents that Services delivered during the contract period were deficient or dis-satisfactory. The Company reserves the sole discretion to examine the compliant of the User and Report on delivery of Services and Company’s decision shall be final and binding on all parties. In-case the Company on evaluation of relevant evidence determines that Services rendered were deficient or unsatisfactory, then the User shall be entitled to claim charge-back for such amount from the Transaction amount as is proportionate to the Services yet to be rendered.

Please send your Complaint/ Charge-back request with your order number by clicking on info@cybernatics.us. Which you had received from us as acknowledgment mail immediately after you have completed your transaction, provided you had given valid email id while placing your order. In case you have not received our acknowledgment, then you must provide the date when you had placed your order as well as your name and valid email id to info@cybernatics.us. This will enable us to track your order number and you will receive your correct order number from us. With this correct order number you will be able to register your complaint/ charge-back request by clicking info@cybernatics.us. You will immediately receive confirmation mail with a ticket number registering your complaint/ request for refund/ charge-back request. We will give our decision along with the reply one the service rendered by company against this order within 7 working days. In-case you are still dis-satisfied with our decision then you have the right to claim a charge-back dispute with your credit card company.


In case company encounters technical problems while accessing the computer station of the User for reasons beyond company's control and/or attributable to a User or technical remote inaccessibility of a system due to its condition, and is unable to render Services as per the order, it shall be presumed that satisfactory Services have been rendered to the User and User shall not be entitled to claim charge-back of the Transaction amount.


Kindly read the Terms and conditions and Privacy policy on the Website as it forms a part of this Policy and agreement between the User and the Company.


b. The information a User provides to the Company will be held on the Company’s computers in NY, USA and may be accessed by or given to its staff working outside NY, USA and to third parties who assist the Company in logistical or technical processing who need to know such information to perform their duties effectively. These parties process information, assist in delivering technical services, process credit-card payments, and provide support services on Company’s behalf. The Company may also pass aggregate information on the usage of its Website to third parties, but this will not include information that can be used to identify a User. The Company may also allow carefully selected third parties, including other companies in its group, to contact a User occasionally about products and Services which may be of interest to him/her. They may contact a User by email, telephone or mobile number. If a User would like to unsubscribe any particular Service, he/she may unsubscribe to the Services through the unsubscribe link on the Website or by following the procedure to unsubscribe as mentioned in the Company’s e-mails.


c. If the Company’s business enters into a joint venture with or is sold to or merged with another business entity, User’s information may be disclosed to its new business partners or owners.


d. Company conducts periodic analysis and survey of the traffic to Website for market research and advertising purposes. Company reserves the right to share User’s information with its appointed market research and advertising companies or firms from time to time for the said purposes. Company may also use cumulative non-personal information for auditing and analysis purposes with the aim of improving its Services. Company may use software applications for website-traffic analysis and to gather statistics, which may be used for advertising and for determining the efficacy and popularity of Services on the Website.


4. Information of a user on Website:

a. Users will not be able to learn about other Users’ personal identifiable Information who place orders for technical services on the Website.


b. When visiting Website from a public or shared computer in a cyber café or otherwise, certain information about a User, such as information filled in the order form may also be visible to others who may use that computer after him/her. It is a User’s responsibility to ensure his/her private information is removed from the public or shared computer incase he/she uses such facility.


5. Security of User’s Data:

a. The Company takes proper security measures to maintain the safety of a User’s Personal Identifiable Information when he/she places an order on the Website, or share his/her Personal Identifiable Information or logs into the Website. These security measures include: password-protected directories and databases to safeguard User’s information, SSL (Secure Sockets Layered) technology to process payment processing and ensure that his/her information is fully encrypted and sent across the Internet securely, or antivirus software to actively protect the Company’s servers from hackers and other vulnerabilities.


b. The Company offers the use of a secure server. All supplied sensitive information such as credit card information is transmitted via Secure Socket Layer (SSL) technology of the Payment Gateway service provider and then encrypted into its Payment gateway provider’s database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. After a transaction, User’s private information (credit/debit cards, cash cards, financials, etc.) will not be stored on Company’s servers.


c. The Company uses reasonable security measures to protect a User’s Personal Identifiable Information against unauthorized access and disclosure. However, although the Company works very hard to protect User’s privacy, it does not promise, and User should not expect, that his/her Personal Identifiable Information or private communications will always remain private.


6. Correction/Updating Personally Identifiable Information:

Personal Identifiable Information of a User can only be changed by contacting Company’s Customer Service. User is required to promptly update his/her personal information if changes occur or information is inaccurate.


7. Retention of User Information:

The Company does retain Personal Identifiable Information of Users to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce its Agreement, and take other actions otherwise permitted by law.


8. Cookies:

a. The Website utilizes 'cookies', small computer files that can be stored by a User’s browser on his/her computer's hard drive for the purposes of obtaining configuration information and analyzing web-viewing habits. Cookies can save a User from having to log in again when re-visiting a Website. If a User sets his/her browser to reject cookies, he/she can still use the Website. Cookies used on this Website help to support the functionality of the Website, for example, by keeping track of a User’s visual preferences or controlling the frequency of "pop-up" windows. A User is free to prevent cookies from being saved on his/her hard drive by adjusting the corresponding settings in his/her browser.


b. Company will automatically receive and collect certain anonymous information in standard usage logs through the Web server, including computer-identification information obtained from "cookies" sent to a User’s browser from a web-server, cookies stored on his/her hard drive and IP address assigned to the computer which he/she uses, the domain server through which he/she accesses Services, the type of computer he/she uses and the type of web browser he/she uses, amongst other information.

Company may maintain log files which contain IP addresses. An IP address is a numeric address that may be assigned to your computer by your Internet Service Provider. In general, we use log files to monitor traffic on our websites and to troubleshoot technical problems. In the event of User abuse of our Website, however, we may block certain IP addresses. If available, IP addresses may be used to personally identify you in order to enforce our Terms of Service.


10. Third-Party Websites:

The Website may contain links to third party Products or Services. The fact that we link to a website is not an endorsement, authorization or representation of Company’s affiliation with that third party. If a User clicks on a link to a third party site, including on an advertisement, if any, User will leave the Website and go to the third party website Because Company cannot control the activities of third parties, Company cannot accept responsibility for any use of User personal information by such third parties, and Company cannot guarantee that such third party shall adhere to the same privacy and security practices as that of the Company. Company advises its Users to review the privacy policies of any other service provider from whom a User requests services. This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the website.


11. How we Protect user from Web Crawlers or Spams:

The Company assures User that it will use his/her name, e-mail address, telephone number or mobile numbers with his/her express consent only for the purposes stated in the Agreement. The Company shall not rent or sell User’s name, e-mail address, telephone number or mobile number to third parties, and it will prevent users details from being recorded by "web crawlers" or "web spiders" to the best of its ability.


12. Terms and Conditions

a. User is advised to visit the Company’s Terms and Conditions section establishing the use, disclaimers, and limitations of liability governing the use of the Website.

b. This Privacy Policy discloses only how the Company collects information and the purposes for which it may be used.


13. User’s Consent

By using the Company’s Website, User consents to terms of the Agreement, including Privacy Policy and Terms of Use and Charge back and Refund Policy.

All comments, queries and requests relating to use of a User’s information are welcomed and should be addressed to the customer services division at contact particulars provided on the Website.


15. Product Return and Refund Policy:

 

We accepts and ships physical product orders only to customers within the continental United States, Alaska, Hawaii, United States territories, Canada, Australia, Austria, Belgium, Denmark, Finland, France (Mainland only), Germany, Iceland, Ireland, Italy, Netherlands, New Zealand, Norway, Spain, Switzerland, Sweden, and the United Kingdom. Products ordered by customers in the following countries will only be delivered via Electronic Software Downloads: Argentina, Chile, Colombia, Costa Rica, Czech Republic, Dominican Republic, Ecuador, El Salvador, Guatemala, Greece, Honduras, Hong Kong, India, Israel, Luxembourg, Malaysia, Mexico, Nicaragua, Panama, Paraguay, Peru, Philippines, Poland, Portugal, Russia, Singapore, South Africa, Thailand, Turkey, Uruguay and Venezuela. No shipments can be made to APO, FPO or PO Box addresses, or addresses outside the above listed countries. You may not export any products purchased from your sites.

 

SALES TO END USERS ONLY, we only accept orders and ships products to end user customers.

 

If you are not satisfied with your purchase of a product, please contact Customer Support for a Return Material Authorization (RMA) request within 14 calendar days of the receipt of the product. The product must be returned to us within 14 calendar days of the issuance of the RMA. We do accept REFUND OR RETURN FOR SERVICE BASED INDUSTRY. All physical products must be packed in the original, unmarked packaging including any accessories, manuals and documentation that shipped with the product. If the item is returned unopened in the original box, we will exchange it or offer you a refund based on your original method of payment excluding any shipping charges (other than the original shipping costs invoiced by us for European customers). If your product was delivered via Electronic Software Download, then you are required to complete and return our Letter of Destruction or complete the Confirmation of Destruction process. How to request a refund Within14 days of receipt of your product:

 

1.Contact Customer Support to make arrangements for a return and receive a Return Material Authorization (RMA) number.

 

2. If you received a physical product, ship the unopened product to us.

3. If you received your product via Electronic Software Download or if you have opened your physical product, then you are required to complete and return our Letter of     Destruction or complete the Confirmation or Destruction process via e-mail.

 

4. A refund* will be processed within 3-6 weeks of receipt of the product at Cybernatics (Gr. Of Future Fifty) and completion of the destruction process described in step 3 above, if applicable.

 

*Please note that we do not permit the return of, or offer refunds for, the following products:

 

1. Volume License software orders*

2. Products obtained as part of a bundle with other computer services or equipment, or distributed by another company as part of their software compilation.

3. Products that were acquired for free (not for resale), including trial versions or other products downloaded for free off our web site or other third party electronic distribution sites.

4. Shipping charges (outside USA).

5. Products obtained by any customer in any other country other than the continental United States, Alaska, Hawaii, United States territories, Canada, Australia, Austria, Belgium, Denmark, Finland, France, Germany, Iceland, Ireland, Italy, Netherlands, Norway, Spain, Switzerland, Sweden, and the United Kingdom.
